Terms, Conditions and Official Rules

                                                                            The Carolina Treasure Hunt, LLC

To purchase a ticket to participate and/or to participate in a Carolina Treasure Hunt sponsored by The Carolina Treasure Hunt, LLC (“Treasure Hunt”) is taken as an acknowledgement and acceptance of these and the following Terms, Conditions and Official Rules.

                                                                            Terms, Conditions and Official Rules:

  1. Participants agree that on their behalf and on behalf of their heirs, executors, personal representatives, administrators and assigns, to: (1) release and forever discharge the Carolina Treasure Hunt and all of it's representatives, of and from all liabilities, claims, actions, damages, costs or expenses of any nature whatsoever including, but not limited to, bodily injury and property damage ("Claims") arising out of or in any way connected with the participation in an event held by The Carolina Treasure Hunt and (2) indemnify and hold The Carolina Treasure Hunt, it's affiliated companies, and each such company's officers, directors and employees ("Released Parties") harmless against any and all Claims made or incurred by third parties in connection with participation in an event held by The Carolina Treasure Hunt. My indemnification obligations shall include, without limitation, all attorney's fees and costs incurred by any of the Released Parties through and including any appeals. I expressly agree that this release and indemnity agreement includes, without limitation, any claims based on the negligence, action or inaction of any of the Released Parties, and covers bodily injury (including death) and property damage, whether suffered by me before, during or after such participation.

  2. Participants agree to follow all local laws, including traffic laws and ordinances, when involved in any treasure hunt event. Participants agree to put safety first and be cautious of their surrounding and courteous to others who are in their search vicinity or on social media when engaged in conversation about the treasure hunt.

  3. There will be no digging required in order to find the Carolina Treasure Hunt Bottle that contains the scroll. The bottle may be located under leaves, grass, or other landscape materials but will not require the use of any tools, such as a shovel, in order to locate. The bottle may also be located inside of a fake rock that may be placed out in the open. The bottom of the rock will have an obvious access point and will not require tools of any kind to open.

  4. Any and all participants whether ticket purchaser and/or any team members of an event, fully acknowledges and agrees to the Terms, Conditions and Official Rules of The Carolina Treasure Hunt. Any ticket event purchaser is responsible for any and all team members to read and acknowledgment and consent to The Carolina Treasure Hunt, LLC. Terms, Conditions and Official Rules.   

  5. Please be mindful of public hours for the locations that you search. The bottle may be hidden at a location that has hours of operations that are open to the public. If you decide to search at an area with public hours, you agree to only search during those hours posted or listed. It is your responsibility as a treasure hunter to know the hours of operation of a location you wish to search. The Carolina Treasure Hunt, LLC., or sponsors will not be held liable for any criminal charges of trespassing of any property from any participant(s) in The Carolina Treasure Hunt , LLC. events. The bottle will not be hidden in a location that will require you to pay admission to gain access to the hidden bottle. The bottle may however, be hidden in a parking area or a location that has a separate area that may require admission but the bottle would be hidden prior to the access point where the admission fee would be required. The Carolina Treasure Hunt, LLC, will never hide the bottles on private property that would cause participants to trespass upon said properties however, if the location has limited hours you must abide by posted or listed public hours or hours of operation(s). 

  6. Grammatical errors in the riddles and puzzles are usually intentional. It does not mean that a mistake can’t be made but most grammatical errors or misspellings are intentional.

  7. A ticket event purchase will allow the ticket purchaser, and up to one additional adult (18 or over) member to join as a team plus any minor children in the ticket purchaser's immediate household can play with the ticket purchaser's supervision for free. Only the registered ticket purchaser will receive prize money if a winning prize treasure bottle is found by his/her team. It is up to the registered ticket purchaser to disperse any prize money to team members in the event that your team wins any cash prizes. The ticket purchaser will be responsible for filling out any tax forms for prizes over $599.

  8. Please hunt with safety in mind at all times. Please do not venture into areas that you are unfamiliar with or look unsafe. Please do not expect to go deep into wooded areas that will require the use of hiking gear. Most hiding locations will be close to a public area, parking area, or clearly marked trail. The location of a treasure bottle will not be more than a 5 minute walk into a wooded area and as stated, will be close to a marked trail. However, please be advised that there will be certain mobility that may be required to locate the treasure bottle. Moderate walking, climbing of steps, walking up and down hills as well as uneven terrain may be required. You will also need to be able to drive or obtain transportation to the locations where the treasure bottles are located once you figure out the clues. Please be aware of your surroundings and be cautious.  The point of The Carolina Treasure Hunt is to have fun, build memories and awaken your sense of adventure but always put safety first and use your better judgment!

  9. Refunds will be given upon request for any reason up until the event date at 9:00 am. After that time, no refunds will be given for any reason.

  10. All participants of an event acknowledge and agree that only one prize will be awarded for each bottle in each event. Once a participant or team has found and claimed the correct winning treasure bottle and verified the code that is inside each bottle, that bottle is considered completed to all remaining ticket purchasers and team(s) of that event and no one else can claim that bottle award or prize.

  11. You must purchase an event ticket for a specific county, date and timed event to be eligible to claim any prize money for that specific event in which a ticket was purchased for.

  12. If you are one of the skilled participants who finds a bottle, you will be required to participate in the prize fulfillment process. That process may require sending pictures in of yourself with the prize bottle and scroll, providing information necessary to complete a W-9 form, state issued drivers license or some form of photo identification and sign any documents that may be required prior for any prize money received. Any prize won over $599 will be issued an IRS Form 1099-MISC. You will have to provide a social security number that will be used on the 1099-MISC.

  13. Your pictures and images may be used in our promotions and/or posted on our social media pages or website as a winner or participant.

  14. The Carolina Treasure Hunt, LLC has the final say and determination in all areas of the treasure hunt, including but not limited to, interpretation of riddles, puzzles and clues, determination of final winner, and all other aspects of the treasure hunt. The Carolina Treasure Hunt, LLC has the right to alter or change terms, conditions and official rules, policies or procedures at any time.

  15. Instructions on how to claim the prize will be located inside the glass bottle on the winners scroll. The first person to have the bottle in hand and deliver the code by the instructions specified on the scroll contained inside the bottle is considered the winner of that prize and that bottle is over for all ticket purchasers of that level event..

  16. Each event hunt will begin on the date and time posted on The Carolina Treasure Hunt website for the treasure hunt ticket events. An email will be sent to you at the email address you provided at the time of your ticket purchase. The email will be sent at the start time of the treasure hunt. The email will contain a Access Code that you can use to enter on our website for your purchased hunt event. Once the Access Code is entered, you will have access to the riddles, puzzles and clues associated with your treasure hunt event. A new clue will be released on that page, and possibly through sponsors or advertisers of the hunt, every 2 hours until all of the bottles for that hunt event have been found. If you have not received an email by the time the treasure hunt has started, please check your spam mail or reach out to us directly through message for your access code.

  17. The Carolina Treasure Hunt, LLC is not responsible for issues in participants sending or receiving emails or delays due to email service provider, user settings, internet access or internet service provider or user error of any kind: i.e., failure to provide an accurate email address at time of ticket purchase. If you do not receive an email with your Access Code within 15 minutes after the start of the hunt and you have checked your spam mail, please email support@thecarolinatreasurehunt.com or call 336-307-9261 and provide your ticket purchase information and email address used at the time of purchased ticket and another email will be sent to you.

  18. Any sort of violence, physical force or unsportsmanlike conduct during the hunt or at the prize site(s) will result in disqualification.

  19. In the event of a disqualification, cancellation due to severe weather or unsafe hunting conditions, or where the winner of a specific prize cannot be determined, the hunt will be reheld on a new specified date to be determined by The Carolina Treasure Hunt, LLC and it’s sponsors. Refunds will be given in this instance if requested by the purchaser.

  20. Internet access and a valid working email address is required to participate. As well, winners who find the treasure bottles will need to text the code located inside of the bottle so a smartphone is advised. Please keep your phones charged up or take a back up battery with you as well.

  21. If fewer than 150 tickets are purchased for any particular treasure hunt event, the The Carolina Treasure Hunt, LLC and it’s sponsors reserve the right to cancel or reschedule the hunt and will provide a full refund or new date to all those who purchased tickets.

  22. By entering, Participant, and anyone they include in their Team, agrees that all information provided by The Carolina Treasure Hunt, LLC and it’s sponsors with respect to this Treasure Hunt is confidential and Participant, on behalf of themselves and anyone on their Team, agrees that they will not publicly reveal the riddles, clues, puzzles or answers to any third party. Publicly revealing any information will disqualify the Participant and, if applicable, their Team, and may result in legal action. Riddles, clues, puzzles or answers may only be shared in private with your team.

  23. This is a game of skill and at no time will the winner of the prize be selected by a random drawing and being a winner is not based on chance.

  24. While participating in a Hunt, Participant agrees they will maintain safe and appropriate contact with other participants and other people they may encounter. Participant will not harass, threaten, or otherwise violate the legal rights of others.

  25. Participant will not trespass, or in any manner attempt to gain access to any property or location where they do not have a right or permission to be, and will not otherwise engage in any activity that may result in injury, death, property damage, nuisance, or liability of any kind.

  26. Participant assumes all risks relating to your communications and interactions with other participants and with other persons with whom they communicate or interact with as a result of participation in any Treasure Hunt event. Participant understands and acknowledges that Sponsor(s) does not screen or inquire into the background of any participants. The Carolina Treasure Hunt or Sponsor(s) makes no representations or warranties as to the conduct of participants.

  27. Participants are purchasing the opportunity to solve riddles, puzzles or clues that when solved correctly will give them the location of a treasure bottle. Participants are only given a cash prize if they are the first person or team to locate the treasure bottle for each skill level on the day of the hunt.

  28. The winner will be posted to The Carolina Treasure Hunt and/or Sponsor(s) website after winner confirmation

  29. The Carolina Treasure Hunt, LLC is in no way sponsored, endorsed, or administered by, or associated with Facebook, YouTube, Instagram, Twitter, or any third-party. Use of their trademarks or intellectual property is incidental to this promotion.

 

GOVERNING LAW, ARBITRATION AND DISPUTE RESOLUTION. PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS THE WAY IN WHICH ANY CLAIM OR DISPUTE BETWEEN YOU AND THE CAROLINA TREASURE, LLC OR THEIR SPONSORS IS RESOLVED.

  1. Governing Law. Unless the laws of your jurisdiction require that the laws of that jurisdiction govern, in which case the laws of such jurisdiction shall govern, all claims arising out of The Carolina Treasure Hunt, LLC and all issues and matters concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights of Participant(s), shall be governed by and construed in accordance with the laws of the State of North Carolina and the United States of America, without regard to conflict of laws principles. Any and all disputes, claims, and causes of action arising out of, or connected with, The Carolina Treasure Hunt, LLC shall be resolved individually, without resort to any form of class action.

  2. Process. Any claim, controversy, or dispute (whether in contract, tort, or otherwise) arising directly or indirectly out of or related to The Carolina Treasure Hunt, LLC shall be resolved exclusively by a final and binding arbitration administered by the American Arbitration Association (the “AAA”) and conducted before a sole arbitrator pursuant to the applicable Rules and Procedures established by the AAA. The filing fee(s) and costs related to any arbitration will be borne by the individual filing the arbitration claim. This arbitration agreement is made pursuant to a transaction involving interstate commerce, and shall be governed by the Federal Arbitration Act (the “FAA”), 9 U.S.C. §§ 1-16. The arbitration shall be conducted in the English language. The arbitration shall be held at a location in North Carolina as determined by Sponsor or at such a location as may be mutually agreed by the Participant and Sponsor. The arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the Participant may have entered into in connection with the Treasure Hunt. The arbitrator shall apply the laws of the State North Carolina with the FAA and applicable statutes of limitations, and shall honor claims of privilege recognized at law. Under no circumstances will a Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim indirect, incidental, consequential, and/or punitive damages and any other damages, other than for actual out-of-pocket expenses related to submitting an Entry, and any and all rights to have damages multiplied or otherwise increased. Sponsor’s total cumulative liability in connection with the Treasure Hunt, whether in contract or tort or any other legal theory, shall not exceed $100.00.

  3. No Class Action or Consolidated Proceedings. Any arbitration that occurs will take place on an individual basis. Class arbitrations, class action suites or consolidated proceedings are not permitted as a way to resolve any claim or dispute.

  4. Scope. This agreement to arbitrate claims and disputes is intended to be broad and includes, without limitation, (i) claims or disputes relating to any aspect of The Carolina Treasure Hunt, LLC whether based in contract, tort, statute or any other legal theory, (ii) claims or disputes directly or indirectly arising from conduct or events that occurred prior to the effective date of these Rules (including, without limitation, claims relating to advertising), or after its termination, (iii) claims or disputes subject to class action litigation in which you are not currently a member of a certified class, and (iv) claims or disputes with any agent, employee, successor or assign of you, the Sponsor, or the Administrator (all such claims and disputes are referred to collectively as “Claims”). This agreement to arbitrate does not, however, include Claims pertaining to intellectual property rights.

  5. No Preclusive Effect. No award or finding or stipulation of fact by the arbitrator will have any preclusive or collateral estoppel effect in any other arbitration or court, unless it involves the exact same parties.

  6. Severability. If any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable or illegal provision were not contained herein.

  7. Severability of Official Rules: In the event any provision of these Official Rules is held to be unenforceable, these Official Rules will continue in full force and effect without such provision. If any provision contained in these Official Rules shall for any reason be held to be excessively broad as to duration, geographical scope, activity, or subject, it shall be construed by limiting and reducing it, so as to be enforceable to the extent compatible with applicable law. These Official Rules are intended to be the complete, final, and exclusive statement of the terms of the agreement between each Participant and the Sponsor relating to the subject matter.
